After being given multiple chances to straighten out her life, Amber Portwood decided to no longer comply with her parole, lied about medical issues and asked a judge to sentence her to jail.
And he did just that.
Leaving him with no choice, due to her relapse, the judge enforced terms of her plea agreement from this winter, sentencing her to five years in prison. He has also referred her to an Indiana Department of Corrections therapeutic community program – incarceration-based rehab.
Prosecuting Attorney Rodney Cummings said that she will most likely spend two-and-a-half years in prison before being released on parole for the remainder of the five years (after each day is successfully served, inmate are rewarded with a day reduced from their prison time). It is also possible for her to receive a reduced 30-days for completing a drug rehab program while in prison.
While away, father Gary Shirley will have custody of their 3-year-old daughter.
